Need An Advocate ASAP To Deal With CPS
Posted on 21 Jun, 2010

I am the grandmother of a wonderful 5-1/2 year old autistic boy. On April 1st of this year CPS (Child Protective Services) removed him from our home based on a call from a neighbor bent on revenge. (That's another long story). They have kept this young man in a foster home and are giving him medical treatments that the parents do not approve of and are not being made aware of. They had him get immunizations that the parents very definatly said they did not want and are taking him to the original doctor who diagnosed him over two years ago and has had no contact with their son since the one time he saw him to diagnose him. The parents would not have known about this had they not been given a calendar of their visitation with him and it was posted on the calendar. The only thing that keeps him from being returned to his parents that is apparent to us is the drug issues that his parents had. I emphisze the word HAD. Both have tested clean and are tested several times a week. Both are doing everything that has been asked of them and are constantly told by CPS workers that they are "the exception to the rule" and "wish we could clone you as clients" because they are doing everthing so well and willingly. They have given up that life style and are dedicated to their son. Mother just gave birth to a second son and gave it up for adoption to a relative that couldn't have children because the parents felt it would be unfair to bring a new baby into the mix of what they are dealing with and want to concentrate solely on their first born. At no time was this child in any danger. I know because they live with me. My question is this....If these parents are doing so well according to CPS, then why have they not returned the child and how can they obtain medical care without the parents permission? These parents have no resources and noone who cares about how all this is affecting their autistic son.

I sincerely thank all of you who cared and took the time to offer advice. Timmy cane back home on Oct.29th and is here to stay. He is in Kindergarten at the elementary school just a block away and loves it. Each day is a joy as he is so unpredictable and can come up with some very funny stuff. His parents are doing awesome with their sobriety as well. We have an IEP and services/therapists to work with him outside of school also. He is doing GREAT!!

They have an organization called the Exceptional Children's Assistance Center (ECAC), a United Way agency, in my state, that has helped me out with a legal matter with my son's school. I don't know if they could be of help to you in your situation, but it would be worth a google search and a few phone calls to find out. Good luck and God bless.

I can't stress the importance of having a lawyer when it comes down to these kind of issues...

Definitely try reaching out to an advocate. That will be a start, even if you don't necessarily hire them...they will guide you in the right direction

Yeah, it would be in the bests of interests to speak to an attorney, or somebody who has experience in dealing with these types of situations.

Somebody needs to advocate for that child in the state's custody.
